El presente libro recopila algunas de las mejores investigaciones presentadas en el “IX Coloquio Internacional de Estética y Arte” en La Habana en diciembre del 2015, redactadas ahora a modo de artículos. La estética y el arte a debate II está compuesto por 27 artículos y se encuentra dividido en cinco bloques que, de alguna manera, reflejan las temáticas centrales alrededor de las cuales giró el encuentro del 2015. En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

Las teorías que usamos para representar el mundo pueden ser extremadamente complejas. Abordan temas tales como electrones, campos cuánticos, estrellas de neutrones, materia oscura, redes neuronales, mercados económicos, la atmósfera y muchas otras entidades que suponemos existen en el universo. Al formular nuestras teorías, recurrimos a lenguajes exactos que nos permiten minimizar la vaguedad y expresarnos lo más precisa y cuantitativamente posible. Recurrimos a la matemática. Cuando formulamos nuestras teorías fácticas en lenguaje matemático, estas se refieren no solamente a objetos (...) que nosotros interpretamos como materiales, tales como partículas o personas, sino también a entidades más raras de un mundo abstracto: conjuntos, números, funciones, espacios algebraicos, variedades, topologías, y otras entidades similares. Estos objetos no son materiales en el sentido en que nosotros decimos que una manzana es material. Ellos no existen en el espacio-tiempo, no interactúan, no cambian o evolucionan. Sin embargo, allí están, profundamente arraigados en nuestras teorías más apreciadas acerca del mundo. (shrink)

There has been much debate recently on the question whether essence can explain modality. Here, I examine two routes to an essentialist account of modality. The first is Hale's argument for the necessity of essence, which I will argue is — notwithstanding recent attempted defences of it — invalid by its very structure. The second is the proposal that it is essential to essential truth that it is necessary. Este trabajo se propone dos objetivos, uno descriptivo y otro propositivo. El descriptivo consiste en el análisis de la crítica que realiza E. Cioran, a lo largo de su obra, a la concepción humanista del ser humano Nuestro filósofo pone en cuestión la arrogancia del hombre que se coloca en el lugar fundamental y de supremacía en el ámbito de la vida, lugar que le sirve de justificación para conquistar, apropiarse y aniquilar a la naturaleza y al resto de los (...) vivientes. Por otro lado, en términos propositivos, me interesa plantear la cuestión de la animalidad(el animal que es el ser humano, y los animales no humanos) porque permite poner en cuestión esa concepción humanista, y pensar nuevos modos de ser-con lo viviente. En este sentido, sostengo a lo largo del trabajo que la filosofía de Cioran permite pensar una noción de lo humano atravesada por la animalidad, noción cioraneana que desarma("descompone") la arrogancia de los humanismos. Para ello me serviré de la problemática de la muerte como inmanente a la vida y de la crítica de Cioran a la noción de propiedad. (shrink)

This brief review of Mario Bunge’s research on physics begins with an analysis of his masterpiece Foundations of Physics, and then it discusses his other contributions to the philosophy of physics. Following that is a summary of his more recent reactions to scientific discoveries in physics and a discussion of his position about non-locality in quantum mechanics, as well as his changing opinions on the nature of spacetime. Background: Eye movement desensitization and reprocessing [EMDR] is an innovative, evidence-based and effective psychotherapy for post-traumatic stress disorder [PTSD]. As with other psychotherapies, the effectiveness of EMDR contrasts with a limited knowledge of its underlying mechanism of action. In its relatively short life as a therapeutic option, EMDR has not been without controversy, in particular regarding the role of the bilateral stimulation as an active component of the therapy. The high prevalence of EMDR in clinical practice and the dramatic increase (...) in EMDR research in recent years, with more than 26 randomized controlled trials published to date, highlight the need for a better understanding of its mechanism of action. Methods: We conducted a thorough systematic search of studies published until October 2017, using PubMed, ScienceDirect, Web of Knowledge and Scopus databases that examined the mechanism of action of EMDR or provided conclusions within the framework of current theoretical models of EMDR functioning. Results: Seventy-five studies were selected for review and classified into three overarching models; (i) psychological models (ii) psychophysiological models and (iii) neurobiological models. The evidence available from each study was analysed and discussed. Results demonstrated a reasonable empirical support for the working memory hypothesis and for the physiological changes associated with successful EMDR therapy. Recently, more sophisticated structural and functional neuroimaging studies using high resolution structural and temporal techniques are starting to provide preliminary evidence into the neuronal correlates before, during and after EMDR therapy. Discussion: Despite the increasing number of studies that published in recent years, the research into the mechanisms underlying EDMR therapy are still in its infancy. Studies in well-defined clinical and non-clinical populations, larger sample sizes and tighter methodological control are further needed in order to establish firm conclusions. (shrink)

It's time that philosophers read Gloria Anzaldúa as a philosopher. Scholars have been hinting at it for some time, but in describing her they still tend to choose the terms “theorist,” “feminist,” and “thinker” instead of “philosopher.” Anzaldúa fits into all of these categories, but from her notes, we know that Anzaldúa also thought of herself as a philosopher. In 2002, for instance, she called herself a “feminist‐visionary‐spiritual‐activist‐poet‐philosopher fiction writer.” This essay argues that we should grant Anzaldúa's wish to be (...) considered a philosopher in addition to the other appellations, and focuses on works that she read and wrote in the first half of her scholarly career, including the publication of Borderlands/La Frontera in 1987. The evidence for the claim that Anzaldúa thought of herself as a philosopher is mostly archival, but some of it also appears in her published works. Once philosophers explicitly begin to recognize Anzaldúa as a philosopher, comparisons between her and other already recognized philosophers will become fuller and bear more fruit. (shrink)

The concept of ideology is central to the understanding of the many political, economic, social, and cultural processes that have occurred in the last two centuries. And yet, what is the nature of the different ideologies remains a vague, open, and much disputed question. Many political, sociological, and ideological studies have been devoted to ideology. Very little, on the other hand, has been done from the philosophical field. And this despite the fact that there are undoubtedly many philosophical questions related (...) to ideology and its role in modern industrialized societies. Just a few examples of ideology-related philosophical questions suffice to prove the point: What objects do ideologies deal with? Are the ideologies testable? Are there true ideologies? Do they evolve? How are ideologies related to societies? Is the existence of ideologies inevitable in modern societies? What is the relation of ideology to science? Is science just another kind of ideology? Are we, as human beings, innately predisposed to believe in ideologies? Or, instead, ideologies proliferate through indoctrination and propaganda? Are ideologies necessarily harmful?...and much more. In this article I try to answer some of these questions from a philosophical point of view, taking a materialist approach. I begin by characterizing ideology as a complex, multi-layered concept. Then, I briefly discuss the material systems on which ideological movements operate, that is, societies and concrete human groups. I identify at least 11 different elements that seem to be present in most ideologies, and I compare these characteristics with those of contemporary science and technology. Although some superficial similarities can be identified, there are deep differences that make ideology completely different from science. The similarities, however, are stronger with technology. Ideologies continually evolve with technological advances, social changes, and even with mere fashion. The current fragmentation of ideologies caused by the widespread use of new technologies and social networks has given rise to new phenomena of ideological propagation which, in my opinion, are very dangerous, particularly for open societies. I discuss these processes, within the context of the nature vs nurture debate, along with the question of whether we can get rid of ideologies. (shrink)

My response philosophically feels around for—and happily fails to find—any boundaries enclosing Hernández Castillo's self-described aim to "decolonize" her feminism. It begins with a story.In an interview with Krista Tippett, Bishop Desmond Tutu recounted an experience that perfectly illustrated a colonized mind. I offer a theory of art that is based on science. I maintain that, as any other human activity, art can be studied with the tools of science. This does not mean that art is scientific, but aesthetics, the theory of art, can be formulated in accord with our scientific knowledge. I present elucidations of the concepts of aesthetic experience, art, work of art, artistic movement, and I discuss the ontological status of artworks from the point of view of scientific (...) philosophy. The present review on dyadic coping (DC) aims at providing a critical integration of both the conceptual and empirical DC literature and overcoming the limitations of past reviews by (a) describing, comparing, and integrating all the DC models, (b) presenting and integrating findings from studies based on DC models, and (c) suggesting directions for further research. The DC models identified and compared include: The congruence model (Revenson, 1994), the relationship-focused model (Coyne & Smith, 1991; O’Brien & DeLongis, 1996), the communal (...) coping model (Lyons, Mickelson, Sullivan, & Coyne, 1998), the systemic-transactional model (Bodenmann, 1995, 1997); the relational-cultural model (Kayser, Andrade, Watson, 2007), and the developmental-contextual coping model (Berg & Upchurch, 2007). After discussing each DC model, we advance a conceptual integration of all models, which serves as the framework to organize the review of the empirical literature. This integration includes the following DC dimensions: (a) Stress Communication, (b) Positive DC by One Partner (supportive DC, empathic responding, delegated DC, active engagement), (c) Positive Conjoint DC (common, collaborative, communal, mutual responsiveness); (d) Negative DC by One Partner (protective buffering, overprotection, and hostility/ambivalence), and (e) Negative Conjoint DC (common negative DC, disengaged avoidance). Developmental, relational, and contextual variables are included as factors shaping DC. To be included in the empirical review, articles had to be published in or a peer-reviewed journal in English and/or German before 2017 and include an original empirical study guided by one of the DC models. The review included 139 studies and, with the exception of CM whose findings were discussed separately, findings were presented for overall DC and each of the dimensions identified in the conceptual integration. Findings were grouped also according to whether the stressor related or not to a medical or mental health condition. Demographic and cultural factors affecting DC were discussed. Overall, the empirical review suggests that in Western couples, positive individual and conjoint DC forms, taken together or separately, have individual and relational benefits for couples coping with stress in general and/or mental health or medical stressors. Research on DC can be expanded to include other populations and stressors and use improved designs. (shrink)

Background Non-adherence to medication is associated with increased risk of relapse in patients with bipolar disorder. Objectives To validate patient-evaluated adherence to medication measured via smartphones against validated adherence questionnaire; and investigate characteristics for adherence to medication measured via smartphones. Methods Patients with BD evaluated adherence to medication daily for 6–9 months via smartphones. The Medication Adherence Rating Scale and the Rogers’ Empowerment questionnaires were filled out. The 17-item Hamilton Depression Rating Scale, the Young Mania Rating Scale and the Functional (...) Assessment Short Test were clinically rated. Data were collected multiple times per patient. The present study represents exploratory pooled reanalyses of data collected as part of two randomised controlled trials. Findings During the study 90.50% of the days were evaluated as ‘medication taken’, 6.91% as ‘medication taken with changes’ and 2.59% as ‘medication not taken’. Adherence to medication measured via smartphones was valid compared with the MARS. Younger age and longer illness duration were significant predictors for non-adherence to medication. Decreased affective symptoms measured with smartphone-based patient-reported mood and clinical ratings as well as decreased empowerment were associated with non-adherence. Conclusions Smartphone-based monitoring of adherence to medication was valid compared with validated adherence questionnaire. Younger age and longer illness duration were predictors for non-adherence. Increased empowerment was associated with adherence. Clinical implications Using smartphones for empowerment of adherence using patient-reported measures may be helpful in everyday clinical settings. Suppose one hundred prisoners are in a yard under the supervision of a guard, and at some point, ninety-nine of them collectively kill the guard. If, after the fact, a prisoner is picked at random and tried, the probability of his guilt is 99%. But despite the high probability, the statistical chances, by themselves, seem insufficient to justify a conviction. The question is why. Two arguments are offered. The first, decision-theoretic argument shows that a conviction solely based on the statistics (...) in the prisoner scenario is unacceptable so long as the goal of expected utility maximization is combined with fairness constraints. The second, risk-based argument shows that a conviction solely based on the statistics in the prisoner scenario lets the risk of mistaken conviction surge potentially too high. The same, by contrast, cannot be said of convictions solely based on DNA evidence or eyewitness testimony. A noteworthy feature of the two arguments in the paper is that they are not confined to criminal trials and can in fact be extended to civil trials. (shrink)

Sin embargo, parece que cierta brecha motivacional está obstaculizando la transformación del modo de vida individual. A fin de dar respuesta a esta brecha, ensayamos una mixtura del enfoque de las capacidades con las teorías de Hartmut Rosa. Argumentamos que la resonancia natural funge de factor personal de conversión necesario, si (...) bien no suficiente, para la capacidad de acción ecosocial; y que una política que promocione la resonancia natural se adecuaría también a los requisitos impuestos al desarrollo humano tanto por el enfoque de las capacidades como por la sostenibilidad. The Western world is experiencing a resurgence of interest in the therapeutic potential of psychedelics, most of which are derived from plants or fungi with a history of Indigenous ceremonial use. Recent research has revealed that psychedelic compounds have the potential to address treatment‐resistant depression and anxiety, as well as post‐traumatic stress disorder and addictions. These findings have contributed to the decriminalization of psychedelics in some jurisdictions and their legalization in others. Despite psychedelics’ opaque legal status, numerous companies and individuals (...) are profiting from speculative investments with few, if any, benefits accruing to Indigenous Peoples. In this paper, we suggest that the aptly named “psychedelic renaissance,” like the European Renaissance, is made possible by colonial extractivism. We further suggest that Indigenous philosophical traditions offer alternative approaches to reorient the “psychedelic renaissance” towards a more equitable future for Indigenous Peoples, psychedelic medicines, and all our relations. En los últimos años, la participación desigual de mujeres en ciencia y tecnología ha sido objeto de atención política y de reflexión académica. En este trabajo, nos concentramos en la situación de las mujeres en dos organismos públicos de investigación y desarrollo en la Argentina - la Comisión Nacional de Energía Atómica y el Instituto Nacional de Tecnología Agropecuaria - para comprender la forma en que estas desigualdades son problematizadas en fuentes documentales y académicas. Además de sistematizar aquellos procesos que (...) aparecen como significativos para la producción de brechas y barreras de género, nuestro relevamiento busca identificar el rol atribuido a los mecanismos de reclutamiento, evaluación, y promoción científica y tecnológica. En ambas instituciones, existen problematizaciones de las brechas de género, así como también de las arbitrariedades e inconsistencias en los procesos institucionales de evaluación, pero ninguna de estas áreas de problematización dialoga con la otra. Retomando los aportes de la sociología política de la ciencia, proponemos que el abordaje de los mecanismos de reclutamiento, evaluación y promoción son clave para comprender las barreras de género que, en tanto mecanismos institucionalizados, dificultan el acceso de las mujeres a ciertas posiciones jerárquicas y áreas de experticia. El examen de estos mecanismos también podría contribuir con el desacople de nociones genéricas, como la de STEM, con las que ha sido abordada frecuentemente la problemática, poniendo el foco en los procesos institucionales propios de los organismos públicos de investigación y desarrollo. Educar implica, en gran medida, transgredir la flecha del tiempo y actuar a modo de contratiempo. Los profesores saben bien que, en numerosas ocasiones, para asegurar el éxito de su acción, deben a menudo "perder tiempo" dejándose paradójicamente llevar por él. El conocimiento del tiempo educativo nos introduce en el estudio de este peculiar contratiempo que, a diferencia del tiempo objetivo, predecible y cronométrico que sirve para racionalizar las actividades pedagógicas, permite a los educadores impedir que en educación el tiempo (...) pase, se consuma sin más, fluya o simplemente suceda. De ahí que la autora plantee las relaciones tiempo y educación desde una perspectiva más integradora, incorporando para ello los múltiples tiempos que confluyen en la realidad educativa junto aquéllos que confieren legitimidad al proyecto educativo. La escuela ha venido recreando un modelo no normativo tiempo -básicamente predictivo y probabilístico- y ha aplicado una racionalidad ahistórica que dificulta la emergencia del sujeto al que se dirige y el modelo de sociedad hacia la que se proyecta. En la actualidad se plantea la necesidad de educar desde una nueva perspectiva ética que integre el tiempo como categoría normativa de acción. Educar hoy para mañana exigirá, en este sentido, atender a dos lógicas temporales: impregnar de historicidad la dimensión de sentido de todo proyecto educativo y planificar las acciones pedagógicas de acuerdo con una nueva tecnología temporal que incorpore la incertidumbre, la complejidad, la interdependencia y la sostenibilidad temporal. Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

Este trabalho tem por objetivo investigar a concepção de fer-ramenta cognitiva no contexto da teoria da cognição incorporada e si-tuada . Para isso, partimos das noções de ferramenta e de tecnologia cognitivas propostas, respectivamente, por Dennett e Dascal , através das quais situam a linguagem no contexto evolu-cionário, ressaltando o seu caráter pragmático. Argumentamos que a concepção de ferramenta cognitiva, que para esses autores está inserida num contexto teórico que privilegia o conhecimento proposicional, pode ser ampliada de modo a abarcar (...) o conhecimento não proposicional. Em seguida, com o propósito de ressaltar a relevância do conhecimento não proposicional, apresentamos algumas teses relativas à natureza dos pro-cessos cognitivos que são postuladas pela CIS e pela Epistemologia Ecológica . Tais teses ressaltam que a compreen-são do comportamento inteligente necessita considerar fatores presentes na complexa dinâmica da interação organismo/meio ambiente. Argu-mentamos, ainda que, graças às teses da CIS e da EE conseguiremos entender alguns fenômenos relacionados à aquisição do conhecimento, es-pecialmente em situações nas quais parece se instaurar uma dicotomia entre significado e ação. In times of crises, public health leaders may claim that trials of public health interventions are unethical. One reason for this claim can be that equipoise—i.e. a situation of uncertainty and/or disagreement among experts about the evidence regarding an intervention—has been disturbed by a change of collective expert views. Some might claim that equipoise is disturbed if the majority of experts believe that emergency public health interventions are likely to be more beneficial than harmful. However, such beliefs are not always (...) justified: where high quality research has not been conducted, there is often considerable residual uncertainty about whether interventions offer net benefits. In this essay we argue that high-quality research, namely by means of well-designed randomized trials, is ethically obligatory before, during, and after implementing policies in public health emergencies (PHEs). We contend that this standard applies to both pharmaceutical and non-pharmaceutical interventions, and we elaborate an account of equipoise that captures key features of debates in the recent pandemic. We build our case by analyzing research strategies employed during the COVID-19 pandemic regarding drugs, vaccines, and non-pharmaceutical interventions; and by providing responses to possible objections. Finally, we propose a public health policy reform: whenever a policy implemented during a PHE is not grounded in high-quality evidence that expected benefits outweigh harms, there should be a planned approach to generate high-quality evidence, with review of emerging data at preset time points. These preset timepoints guarantee that policymakers pause to review emerging evidence and consider ceasing ineffective or even harmful policies, thereby improving transparency and accountability, as well as permitting the redirection of resources to more effective or beneficial interventions. The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

This book proposes a new interpretative key for reading and overcoming the binary of idealism and realism. It explores the way human consciousness unfolds through the relationship between the I and the world-a field of phenomenological investigation that cannot and must not remain closed within the limits of its own disciplinary boundaries. The book focuses on the question of realism in contemporary debates, ultimately dismantling prejudices and automatisms that one finds therein. It shows that at the root of the controversy (...) between realism and idealism there often lie equivocations of a semantic nature. By returning to the origins of modern phenomenology this study mines the Husserlian concept of transcendental idealism. Following this path, and neutralizing the extreme positions of an acritical idealism and a naïve realism, the book proposes a "transcendental realism": the horizon of a dynamic unity that embraces the process of cognition and that grounds the relation, and not the subordination, of subject and object. The close reading of this reciprocity offered here allows one to surpass the limits of the domain of knowing, leading one to fundamental questions about the ultimate sense of things and their origin.
